AGREEMENT BETWEEN BUYER AND CHANNEL / CONSULTANT / AGENT

BETWEEN

 

“M/s/Mr./Ms./Mrs. ___________________________R/o _______________ __________________(herein after called (“Buyer”)

And

 

M/s __________________________________R/o _____________________________________ (herein after called “Channel / Consultant / Agent”)

Having PAN: ____________________________.                                                                               …. party of the second part.

 

The individuals may be known together collectively as parties.

WHEREAS the “buyer” of the property wants to purchase the property as per description in Schedule hereto and for the said purpose the services of the “Channel /Consultant” are required.

AND WHEREAS the said Channel / Consultant / Agent has accepted the offer and desire to act as an intermediary finder of property for buyer.

AND WHEREAS the buyer has accepted to pay to the Channel / Consultant / Agent the present rate of commission of 2% (two percent) of the purchase price.

NOW THEREFORE THIS AGREEMENT WITNESSES That: -

1. The buyer hereby gives the Channel / Consultant / Agent for a period of Six months to find the property which described in the Schedule hereto at the price and on the terms and conditions hereinafter contained in this agreement.

2. The buyer hereby agrees to pay Rs. _______________/- to Channel / Consultant / Agent at the time of singing of the agreement and rest amount at the time of the compilation of agreement.
3. The aggregate liability of the Channel / Consultant / Agent for all Claims/damages regarding property shall not exceed Rs. 10,000/-
4. The Channel / Consultant / Agent shall not be liable for a Claim unless notice in writing summarizing the nature of the Claim and, as far as is reasonably practicable, the amount claimed, has been given by or on behalf of the seller to buyer.
5. It is agreed to and understood that Channel / Consultant / Agent shall receive from the buy of said property as Channel / Consultant / Agent's commission of 2% of the purchase price.
6. For any fee payment that is not paid within thirty days of its due date, buyer shall pay late fee@ of 0.5% to the Channel / Consultant / Agent.

7. The Channel / Consultant / Agent is hereby authorized to find the property on the minimum price of Rs. ____________/- and out of this consideration the Buyer shall pay Rs. _______________/-in advance to Channel / Consultant / Agent as earnest money and the balance shall be paid within a month hereof before the Registrar at the time of registration of the purchase-deed.

8. The buyer is entitled to take possession on property on _________________________
9. The buyer hereby agrees that the purchase-deed to be executed by the him shall be a full covenant warranty deed free from all encumbrances.
10. The term of this Agreement shall commence on the Effective Date and shall continue in full force and effect as described by this Agreement.
