1. Appointment of Agent (एजेंट की नियुक्ति):
The Seller hereby appoints the Agent as the exclusive agent for the purpose of marketing, advertising, and facilitating the sale of the Property mentioned above. The Seller grants the Agent the right to list and advertise the Property using various marketing channels and strategies. विक्रेता इसके द्वारा एजेंट को विपणन, विज्ञापन और ऊपर उल्लिखित संपत्ति की बिक्री की सुविधा के लिए विशेष एजेंट के रूप में नियुक्त करता है। विक्रेता एजेंट को विभिन्न विपणन चैनलों और रणनीतियों का उपयोग करके संपत्ति को सूचीबद्ध करने और विज्ञापित करने का अधिकार देता है।

2. Exclusive Right to Sell (बेचने का विशेष अधिकार):
The Seller agrees that the Agent has the exclusive right to represent the Seller in the sale of the Property during the term of this Agreement. The Seller agrees not to engage, directly or indirectly, with any other real estate agent, broker, or third party to sell the Property during this term. विक्रेता इस बात से सहमत है कि एजेंट के पास इस अनुबंध की अवधि के दौरान संपत्ति की बिक्री में विक्रेता का प्रतिनिधित्व करने का विशेष अधिकार है। विक्रेता इस अवधि के दौरान संपत्ति बेचने के लिए किसी अन्य रियल एस्टेट एजेंट, ब्रोकर या तीसरे पक्ष के साथ प्रत्यक्ष या अप्रत्यक्ष रूप से शामिल नहीं होने के लिए सहमत है।

3. Terms and Duration (नियम और अवधि) :
This Agreement shall commence on [Start Date] and shall continue for a period of [Duration] months, unless terminated earlier in accordance with the provisions of this Agreement. यह अनुबंध [प्रारंभ तिथि] पर शुरू होगा और [अवधि] महीनों की अवधि तक जारी रहेगा, जब तक कि इस अनुबंध के प्रावधानों के अनुसार पहले समाप्त न किया जाए।

4. Listing Price and Terms (लिस्टिंग मूल्य और शर्तें) :
The Property shall be listed for sale at the Listing Price mentioned above. The Seller and Agent shall collaborate to determine appropriate marketing strategies, pricing adjustments, and terms to facilitate the sale of the Property. संपत्ति को ऊपर उल्लिखित लिस्टिंग मूल्य पर बिक्री के लिए सूचीबद्ध किया जाएगा। विक्रेता और एजेंट संपत्ति की बिक्री को सुविधाजनक बनाने के लिए उचित विपणन रणनीतियों, मूल्य निर्धारण समायोजन और शर्तों को निर्धारित करने के लिए सहयोग करेंगे।

5. Marketing and Promotion (विपणन और प्रचार) :
The Agent shall undertake various marketing and promotional activities to attract potential buyers to the Property. This may include online listings, print advertisements, open houses, virtual tours, and other industry-standard practices. एजेंट संभावित खरीदारों को संपत्ति की ओर आकर्षित करने के लिए विभिन्न विपणन और प्रचार गतिविधियां करेगा। इसमें ऑनलाइन लिस्टिंग, प्रिंट विज्ञापन, ओपन हाउस, वर्चुअल टूर और अन्य उद्योग-मानक प्रथाएं शामिल हो सकती हैं।

6. Commission and Compensation (कमीशन और मुआवज़ा) :
In consideration for the services provided by the Agent, the Seller agrees to pay a commission of [Commission Percentage] of the final sale price upon successful completion of the sale. The commission shall be split between the Agent and any cooperating brokers involved in the transaction as per prevailing industry practices. एजेंट द्वारा प्रदान की गई सेवाओं के लिए, विक्रेता बिक्री के सफल समापन पर अंतिम बिक्री मूल्य पर [कमीशन प्रतिशत] का कमीशन देने के लिए सहमत होता है। कमीशन को प्रचलित उद्योग प्रथाओं के अनुसार एजेंट और लेनदेन में शामिल किसी भी सहयोगी ब्रोकर के बीच विभाजित किया जाएगा।

The agent will give information about the seller's property to the potential buyers / negotiate with them about the sale and purchase of the said property / make the buyer visit the seller's property / arrange a meeting between the buyer and the seller in such customer or their immediate family relations (Blood Relations) No deal will be done bypassing the selling agent. If this happens, the seller will pay the full commission to the agent. If the seller refuses to pay commission to his agent, then the agent will have the right to get it through legal process. एजेंट जिन संभावित क्रेताओं को विक्रेता की प्रॉपर्टी की जानकारी देगा / उनके साथ उक्त प्रॉपर्टी की खरीद फरोख्त के बारे में बातचीत करेगा / क्रेता को विक्रेता की प्रॉपर्टी की विजिट करवाएगा / क्रेता व विक्रेता की आपस में मीटिंग करायेगा ऐसे कस्टमर या उनके सगे पारिवारिक संबंधों (रक्त संबंध) में विक्रेता एजेंट को दरकिनार करके कोई भी डील नहीं करेगा। अगर ऐसा होता है तो विक्रेता एजेंट को उसका पूरा कमीशन देगा। यदि विक्रेता अपने एजेंट को कमीशन देने से आनाकानी करता है तो एजेंट के पास ये अधिकार होगा की वे विधिक प्रक्रिया के द्वारा प्राप्त कर सकेगा।

7. Termination (समाप्ति) :
Either party may terminate this Agreement with written notice if the other party breaches any material term of this Agreement or for any other reason mutually agreed upon in writing. In the event of termination, any pending sale negotiations or offers shall be handled in accordance with applicable laws and regulations. यदि दूसरा पक्ष इस अनुबंध की किसी भी महत्वपूर्ण शर्त का उल्लंघन करता है या लिखित रूप में आपसी सहमति से किसी अन्य कारण से उल्लंघन करता है तो कोई भी पक्ष लिखित सूचना के साथ इस अनुबंध को समाप्त कर सकता है। समाप्ति की स्थिति में, किसी भी लंबित बिक्री वार्ता या प्रस्ताव को लागू कानूनों और विनियमों के अनुसार संभाला जाएगा।

8. Confidentiality (गोपनीयता) :
Both parties shall maintain the confidentiality of any proprietary information or data shared during the course of this Agreement. दोनों पक्ष इस अनुबंध के दौरान साझा की गई किसी भी मालिकाना जानकारी या डेटा की गोपनीयता बनाए रखेंगे।

9. Governing Law (शासी कानून) :
This Agreement shall be governed by and construed in accordance with the laws of [State/Country]. यह समझौता [राज्य/देश] के कानूनों के अनुसार शासित और समझा जाएगा।

This Agreement sets forth the entire understanding between the parties and supersedes all prior agreements and understandings. Any modifications to this Agreement must be in writing and signed by both parties. यह समझौता पार्टियों के बीच संपूर्ण समझ को स्थापित करता है और सभी पूर्व समझौतों और समझ का स्थान लेता है। इस अनुबंध में कोई भी संशोधन लिखित रूप में होना चाहिए और दोनों पक्षों द्वारा हस्ताक्षरित होना चाहिए।
